Part 1 -- Health Ins. Market Reforms
Sec 1201 - amends an existing health care law by adding:
Subpart 1 - general reform
sec. 2704. A group plan or health ins. issuer can not exclude coverage
for pre-existing condition
sec. 2701. Prohibiting discriminatory premium rates - age, tobacco use,
individual or family
sec. 2702. Guaranteed availability of coverage
- Each ins. issuer in a State that offers group or individual plans
must accept every employer and individual in that state who applies
- Some restrictions... issuer may have special enrollment periods.
sec. 2703. Guaranteed renewability of coverage
- issuer must continue to renew policy holders
sec. 2705. Prohibiting discrimination against individual participants and beneficiaries
based on health status.
issuer may not make rules of eligibility based on
(1) Health status.
(2) Medical condition (including both physical and mental illnesses).
(3) Claims experience.
(4) Receipt of health care.
(5) Medical history.
(6) Genetic information.
(7) Evidence of insurability (including conditions arising out of acts of domestic violence).
(8) Disability
(9) Any other health status-related factor determined appropriate by the Secretary.
